THE NEW ADMINISTRATIVE COURT PROCEDURAL ACT HAS BEEN FINALLY PUBLISHED
The new Administrative Court Procedural Act has been published in the Official Hungarian Gazette on 1 March 2017 after resolving certain constitutional issues. After the bill was adopted by the Hungarian Parliament in December 2016, the Constitutional Court of Hungary declared several provisions of the Administrative Court Procedural Act unconstitutional concerning the establishment of a new Administrative Court. The bill then was modified accordingly and the Administrative Court was replaced by already existing ordinary courts of Hungary. The modified bill was adopted by the Hungarian Parliament in February 2017.
It is widely expected that the new regulations, together with the new Administrative Procedural Act applicable from 1 January 2018, will strengthen the judicial control of the Hungarian administrative procedures. The act shall serve as a new code with regard to the administrative court procedures, which will no longer regulated in the framework of the Code on Civil Procedures. The new regulations will enter into force on 1 January 2018.
