The EU’s Fair Labour Mobility Package

In September 2026, the European Commission adopted the Fair Labour Mobility Package, which aims to make labour mobility within the EU simpler and safer, as well as to ensure more effective enforcement of the social rights of people living or working in another EU Member State. The package focuses on three main areas: (i) the digitization of social security documents, (ii) the simplification of cross-border recognition of qualifications, and (iii) the more effective enforcement of rules governing EU worker mobility.

As part of the package, the European Social Security Pass system would be established, allowing individuals to access, store, and, if necessary, present their social security documents in a digital wallet. This would include, among other documents, the European health insurance card and the portable document A1 for posted workers.

The Skills Portability Initiative aims to simplify the issuance, comparison, verification, and recognition of qualifications in EU Member States. As part of the initiative, the Skills Portability Act would introduce a standardized digital format for qualifications. The EU rules on the recognition of professional qualifications would also be revised, and a new regulatory proposal would be developed for the recognition of qualifications obtained outside the EU.

The package would also strengthen the role of the European Labor Authority, particularly in the areas of cross-border inspections, dispute resolution, and cooperation among Member State authorities. More effective enforcement of the rules would provide greater protection for workers against unfair practices and abuses. The legislative proposals have yet to be adopted by the European Parliament and the Council.
